The Ordinance defines "EIA" development. Such development is listed in Schedule 1 and a planning permission may not be granted for it unless an EIA has been carried out and the environmental information arising from that EIA has been taken into account in determining the application. Development requiring a Screening Opinion as to whether or not an EIA is required is set out in Schedule 2. The Ordinance sets out requirements for EIA in local planning and other development. It also provides for the determination of an appeal under section 68 of the Law (Appeal to the Planning Tribunal without an Environmental Statement).
