This Act lays down provisions on the establishment, constitution, jurisdiction and functions of the Land Commission for Papua New Guinea; appointment and tenure of and qualification requirements for commissioners; powers, duties, functions and jurisdiction of the Chief Commissioner; delegation and powers of the Deputy Chief Commissioner; appointment of a Special Commissioner or Assistant Commissioner; appointment and duties of the Registrar of the Commission; establishment of a Register for the Commission; declaration of national land; description and certification of the land contained in the declaration by the Registrar; declaration of national land where land was acquired before and after the Independence Day; ownership of national land; conflicting claims in respect of any land, and dispute settlement; determination of the customary land ownership; jurisdiction of the Local Land Court over the disputes relating to ownership by custom or to the right to its use by custom; ownership of customary land for certain purposes; agreement for settlement; marking of land by the Commission; appeals and references to the National Court; conflict with a title previously registered under the Land Registration Act 1981; and power of the Head of State to make regulations for carrying out or giving effect to this Act.
