Abstract

The objective of this Act, composed by twenty parts, is to amend and consolidate the laws relating to labour, employers, trade unions and industrial relations and to establish a National Labour Commission (Part I). It applies to all workers and to all employers (except the Armed Forces, the Police Service, the Prison Service and the Security and Intelligence Agencies specified under the Security and Intelligence Agencies Act 1996). Part II is dedicated to Public Employment Centres and the registration of private employment agencies. Part III regards the protection of employment. Part IV concerns the general conditions of employment and it includes three sub-parts dedicated to annual leave with pay (sub-part I), hours of work(sub-part II), rest periods (sub-part III). Part V covers the issues regarding the employment of persons with disability, Part VI those regarding the employment of women, specifying employers' requirements and women's rights and Part VII those regarding the employment of young people. Part VIII covers the fair and unfair termination of employment and Part IX the protection of remuneration. Part X is about special provisions relating to temporary workers and casual workers. Part XI regards trade unions and employers' organizations and Part XII collective agreements. Part XIII is dedicated to the national tripartite committee. Part XIV is about the forced labour. Part XV regards occupational health, safety and environment. Part XVI regards the labour inspection. Part XVII treats unfair labour practices. Part XVIII, which establishes a national labour commission, is made of two sub-parts treating, respectively, its establishment and functions (Sub-Part I) and the settlement of industrial disputes (Sub-Part II). Part XIX regards strikes. Part XX takes care of miscellaneous provisions (Regulations which may be adopted by the Minister, subject to the provisions of this Act, interpretation, enforcement, offences etc.). the Act is terminated by three Schedules.
