Abstract

This Act establishes villages in Kitui County and provides with respect to their administration. The object and purpose of this Act is to provide for the further decentralization of the functions and provision of services by the Kitui County Government in accordance with Article 176(2) of the Constitution. Villages are established for proper coordination and facilitation of citizen participation in the development of policies and plans and delivery of services. Each village unit shall be administered by a Village Administrator in accordance with the provisions of Section 52 of the County Governments Act, 2012. A Village Administrator shall coordinate, manage and supervise the general administrative functions in the village including- (a) Pursuant to Paragraph 14 of Part II of the Fourth Schedule to the Constitution- (i) Ensuring and co-ordinating the participation of the village unit in governance; and (ii) Assisting the village unit to develop administrative capacity for the effective exercise of the functions and powers and participation in governance at the local level. In each village unit a village council shall be established in accordance with Section 53 of the County Governments Act, 2012. The Village councils shall be responsible for the following:- (1) co-ordinating and ensuring citizen participation in the county governance; (2) assisting respective village to develop administrative capacity for the effective exercise of function and powers; (3) monitoring the implementation of policies and programs at the village level; (4) advising the Ward Administrator and Sub-County Administrator on the matters pertaining to the Village; and (5) any other function necessary for the better administration of the Village.
