Abstract

This Title of Article 17 of the Environmental Conservation Law of New York contains provisions on jurisdiction of the department of environmental conservation of New York, and its authority and powers and duties. More specifically, it provides for classification of waters and adoption of standards; general powers and duties; and establishment of a program to monitor water quality by private citizens under the direction of the department. Notably, the Title provides that the department has administrative jurisdiction to abate and prevent the pollution of waters of the state in the manner provided in this Title in accordance with the classification of waters adopted by the department pursuant to this Title and in accordance with standards, criteria, limitations, rules and regulations and permit conditions adopted, promulgated or applied by the department.
