Joint Order No. 323/242/399 validating the Regulation on the evaluation of damage caused by wild hoofed animals to agricultural crops and forest species and also of the protection thereof against damage caused to agricultural crops and forest species by the aforesaid animals issued by the Ministry of Agriculture and Food, by the Forest Ministry and by the Ministry of Environmental Protection.

Abstract

The Regulation consists of 7 Sections dealing with the following matters: 1) the sphere of application (sect. 1); 2) normative references (sect. 2); 3) terms and definitions (sect. 3); 4) general provisions (sect. 4); 5) evaluation of damage caused to agricultural crops by wild hoofed animals (sect. 5); 6) ) evaluation of damage caused to forest species by wild hoofed animals (sect. 6); 7) recommended arrangements for the prevention of damage (sect. 7). The present Regulation shall be applicable to forestry, agriculture and hunting. Wild hoofed animals shall be considered Artiodactyla (bison, elk, red deer, roe deer and wild boar) living in their natural habitats and subject to hunting. Damaged agricultural crops shall be considered those requiring re-cultivation or causing more than ten percent reduction of yield. All the land tenants and lessees of hunting reserves must carry out the arrangements for the prevention of damaged by wild hoofed animals to agricultural crops and forest species. The arrangements must not lead to the destruction, injuring or sickness of wild animals. Inspection of the damaged agricultural crops shall be carried out at the initial period of vegetation after the appearance of young growth and at the final period of vegetation for agricultural crops before harvest and for the forest species in April. The evaluation of damage caused to agricultural crops must include the reproduction costs. Damage caused to marketable forest trees (pine-tree, spruce, deciduous trees) shall be subject to evaluation. The evaluation of damage caused to forest trees requiring reconstruction must include reforestation costs. It shall not be recommended to sow cereals, oats, barley, maize, leguminous plants and potatoes on the grounds located nearby forests with high population of hoofed animals. Harvest shall be carried out timely within the established agrotechnical periods. For the prevention of damage to forest species the stock of low damage rate species shall be planted and planting of aspen and willow as wild animal feedstuffs. The plantations of aspen and willow can be subsequently transferred under the jurisdiction of hunting reserves.
