Abstract

This Law makes provision in respect of irrigation works and use of water for irrigation by those entitled to do so. The objectives of this Law broadly are: to enhance construction and maintenance of waterworks (collectively called canals in this Law) for agricultural development; to protect such works from natural disaster and to mitigate effects of natural disasters on such works; to meet water requirements in particular for livestock and cultivation; to inform the public at large of terms and conditions for sustainable conservation of canals and its water resources. The Law sets out the procedures for canal construction at national, state, regional and district level. This will involve payment of compensation to land owners that suffer a loss due to canal construction. Maintenance of canals shall be a duty assigned to Region or State Canal Officers, District Canal Officers and Township Canal Officers. Construction of new water course (connected to drains that draw water from a canal) and use of existing water courses shall be approved by the District Canal Officer, who may also deny the right to construct works, transfer of a water course or use water from a canal. Also, any person having interest in the water course or land, may make objections to the District Canal Officer against granting a right to construct or use a water course. Water may be used until crops are mature and a water tax shall be paid for water use. The Irrigation and Water Utilization Management Department shall form the water users group to use water from irrigation or water course effectively in accordance with the stipulations. This group shall manage the amount of water supply themselves and maintain water supply system. The Law also: Imposes certain recording requirements on District Canal Officers, and disaster prevention duties on Region or State Canal Officers, District Canal Officers and Township Canal Officers; provides with respect to emergency works; and specifies prohibited activities and offences affecting canals or water courses.
