Abstract The Act consists of 10 Chapters divided into 99 articles. Chapter 1, General Provisions, states that water is a nature resource, and belongs to the state, the water ownership shall not be changed as the ownership of land. The Act authorizes the Ministry of Economy to be the Responsible Agency at central government level. Chapter 2 establishes the duties of the Responsible Agency at central government level in terms of dividing of irrigation district and reporting to the Executive Yuan to approve and proclaim. Chapter 3, Water Rights, includes surface and groundwater utilization and benefit derived, the individuals or units with water right shall be entitled to use the quantity of water allocated accordingly. Chapter 4, Registration of Water Rights, articles 29 and 30 outline the documents and contents that have to be submitted when applying water right; the content of a water right certificate is given in article 38. Chapter 5, Irrigation Works, establishes the legal framework for irrigation development. Chapter 6 concerns the storage and release of floodwater. Chapter 7 regulates the rules of Water Courses Maintenance. Chapter 8 is about Fees. Chapter 9, Penalties. Chapter 10, Supplementary Provisions. The term of 'Fisheries' is interpreted in article 2. Chapter 4 pays special attention to the fishing activities with entertaining purpose. Article 48 prohibits the unallowable catching methods.
