It also makes extensive provisions for enterprises to which the Act does not apply to. To carry on the activities of manufacturing, an enterprises requires an industrial licence particularly where the products/services presents any health and safety concerns (including environmental concerns) in its manufacturing processes or in the finished product, or where it poses a danger to public health, or if, in the manufacturing process, a danger to public health is likely to occur. Manufacturing enterprises which require this industrial licence is listed by the Act to include industries which manufacture and sell animal feed, baby formula, food, beverages, cement, chemical products, and the Minister may prescribe other products. The Act prescribes a heavy fine and a prison term not exceeding 10 years for contravening the provisions regarding obtaining a licence prior to conducting an enterprise where a licence is required. The Act makes extensive provision incidental to the establishment of an enterprise and also provides penal provisions for contravention of specific provisions.
