Abstract

This compliance policy is a multilateral document aiming at (i) providing guidelines on principles for action and steps to be taken under such extraordinary circumstances; (ii) ensuring that extraordinary circumstances do not undermine the Commission’s conservation and management measures; (iii) all Members, including Cooperating Non-Members (CNMs), understand how to respond to the Commission’s expectations if extraordinary circumstances arise. It establishes that (i) actions taken when extraordinary circumstances occur aim to minimize the risks resulting from noncompliance with or reliance on exemptions from CCSBT and they have to be (i) proportionate to the aforementioned risks; (ii) consistent with international law ; (iii) where possible, provide opportunities to improve the functioning of the CCSBT management regime; (iv) not exacerbate the extraordinary circumstance being experienced; (v) be temporary. Point 4 deals with the steps that need to be taken in cases either of non-compliance or of reliance on exemptions.
