Abstract

This Governmental Decree establishes the procedure for and the amount of compensation for damage to the forest fund and other objects of flora and fauna by natural and legal persons. It shall be applicable to public forest and vegetation growing in natural conditions in protected areas, agricultural land and state reserve land, and also to wild fauna species living in natural habitats. Natural and legal persons who have committed a violation of the requirements of regulatory legal acts in the field of protection and management of forest fund and found guilty shall compensate the damage caused to the forest fund and other vegetation in accordance with this Procedure. Damage caused to the forest fund as a result of a fire or negligence with fire, as well as the cost of all expenses for extinguishing a fire, shall be reimbursed in accordance with the legislation of the Republic of Tajikistan. Forest officers must draw reports related to identified offences. Live illegally captured wild fauna species, including birds and reptiles must be released to their natural environment.
