This Governmental Decree enters into force on 29 January 2019.
Abstract

This Governmental Decree defines the procedure for conducting by legal individuals, individual entrepreneurs engaged in production and (or) turnover of food raw materials and food products the procedure of withdrawal, return, destruction, disposal of food products that do not comply with the established food quality and safety requirements. It shall not be applicable to food products seized, arrested or turned into state revenue. The owner of the foodstuffs or authorized supervisors (supervisory authorities) declare non-compliance of foodstuffs with the established requirements in accordance with the following terms and conditions: (a) by the results of laboratory studies (tests) conducted in accredited (certified) testing laboratories (centers), as well as state registration, state sanitary and hygienic expertise, veterinary and sanitary examination, certification, declaration of conformity; (b) in the presence of obvious signs of poor quality (damage, decomposition, pollution); (c) in case of expiration date of shelf life; (d) in case of violation of the conditions for trade (vending), storage, transportation of foodstuffs; (e) in case of violation of the integrity of consumer packaging; (f) in the absence of (inconsistency) labelling, which led to the impossibility of identification of the manufacturer, composition, shelf life; (g) in the absence of traceability documents and confirming compliance of foodstuffs with established requirements; and (h) in case of falsification of foodstuffs. Foodstuffs that do not meet the requirements shall be subject to withdrawal from circulation and recycling (disposal) on the national territory or export from Belarus.
