This Governmental Decision enters into force on the date of its official publication.
Abstract

This Governmental Decision establishes the procedure for purchase and sale procedure of fertile soil layer removed as a result of construction work on contractual basis. The value of fertile soil layer, calculated by the meter, is determined by the mutual agreement of the landowner and the buyer of the fertile layer, taking into account the qualitative indicators of the fertile layer of the land. The quality indicators of the fertile soil layer are described in a document certifying the quality of soil issued by an accredited laboratory in the field of soil monitoring. The amount received from the sale of the fertile layer of state-owned land shall be transferred to the community budget, and the amount received from the sale of the fertile layer of land excavated from land property owned by legal entities or natural persons shall not be deposited into the budget and shall be managed by the owner. Annex 1 contains the form of permit for the purchase of fertile soil layer removed as a result of construction work. Annex 2 contains the form of purchase and sale contract related to fertile soil layer.
