Abstract

The scope of this Sanitary Regulation is to protect public health. It establishes the necessity to ensure a high level of consumer protection, containing harmonized provisions regarding the maximum allowed residue limits set for phytosanitary products in foodstuffs and animal feedstuffs of plant and animal origin. It shall be applicable to products of plant and animal origin listed in annex 1, intended for use as food or animal feedstuffs. Residues of phytosanitary products shall be intended residues, including active substances, metabolic substances and/or products obtained from the degradation or reaction of active substances currently or in the past used in phytosanitary products from or on the products listed in Annex 1, especially the residues whose presence can be caused by the use of active substances for phytosanitary, veterinary purposes or as biocides. To ensure compliance with this Regulation, official controls are carried out on the residues of phytosanitary products, in accordance with the relevant provisions of the national legislation on official controls on foodstuffs and animal feedstuffs. The National Agency for Food Safety, together with the Ministry of Health, Labor and Social Protection, develops and establishes a national program for the control of residues of phytosanitary products in foodstuffs, which is updated annually. This program is based on a risk assessment and its purpose is, in particular, to determine the degree of exposure of the consumer in compliance with current legislation. The program must contain the following information: (a) products to be selected; (b) the number of samples to be taken and tests to be carried out; and (c) phytosanitary preparations (active substances) that need to be tested.
