Abstract

This Act makes provision for the registration and protection of geographical indications. “Geographical indication” means an indication, however expressed, which identifies a product as originating in a particular area, where some quality, reputation or other characteristic of the product is essentially attributable to its geographical origin. The Trade Marks Office established by the Trade Marks Act shall be responsible for registering geographical indications and for exercising all the other functions of the Trade Marks Office in terms of this Act (sect. 5). A Register of Geographical Indications shall be kept at the Trade Marks Office for the purposes of this Act in accordance with section 7. The Register shall be open to inspection by the public. Section 9 and following concern the prohibition against use of misleading geographical indications and subsequent proceedings. Sections 17 to 20 provide for registration of geographical indications. Sections 21 to 23 concern correction or otherwise modification of the Register, whereas sections 24 to 28 define the powers of the Registrar. Other provisions of this Act define offences and deal with appeals and other procedural matters.
