Abstract

This Act makes provision for the registration and protection of geographical indications, i.e. indication that identifies a good as originating in the territory of a country, or a region or locality in that territory, where a given quality, reputation or other characteristic of the good is essentially attributable to its geographical origin. Protection under this Act is accorded to geographical indications, whether or not they are registered. An application for the registration of a geographical indication shall be filed with the Registrar of the Intellectual Property Office. The Act prohibits improper use of geographical indication and provides for legal proceedings for the protection of rights. Only producers of products possessing the quality, reputation or other characteristic specified in the Register and who are carrying on their activity in the geographical area specified in the Register may use a registered geographical indication, in the course of trade, with respect to such products. Exceptions regarding use of geographical indications are provided for prior users of such indications.
