Abstract The purpose of this law is to regulate relationships related to the registration, preservation, protection, research, development, use, and benefit of genetic resources and traditional knowledge related to genetic resources. This Law applies to genetic resources derived from plants, animals, and microorganisms, and relationships related to traditional knowledge related to genetic resources. It shall not be applicable to human genetic resources. The State shall follow the following principles when using genetic resources and traditional knowledge related to genetic resources: (a) based on research and analysis, based on advanced techniques, technologies and innovations; (b) protection and appropriate use of genetic resources and traditional knowledge related to genetic resources; (c) openness and transparency; and (d) fair and equitable sharing of benefits. Genetic resources originating from the territory of Mongolia are the property of the state. Legal entities may be granted the right to study, conduct bioprospecting, and use traditional knowledge related to genetic resources under the conditions and procedures specified in this law. Discovery of traditional knowledge related to genetic resources, bioprospecting, use without registration in a database, transmission, sale, or benefiting from genetic resources is prohibited without a special license specified in this law. Plants, animals, and microorganisms containing genetic resources shall be protected by preserving and sustaining native habitats, domesticating them, replacing them, re-introducing them, cultivating them, and establishing gene banks, plants, and zoos. No special permit is required for the use of plants specified in the International Treaty on Plant Genetic Resources for Food and Agriculture to which Mongolia is a State Party. The license holder shall submit the following information and reports to the central government administration: (a) annual work report on the use of genetic resources and traditional knowledge related to genetic resources by February 10 of the following year; and (b) every time the information is entered into the database.
