Positive discriminatory measures may be taken only where suitable and appropriate measures are adopted to prevent or compensate for disadvantages (section 5). There is a general prohibition of discrimination in section 7, which stipulates that any discrimination by an employer or employee shall be deemed a violation of their contractual obligations.
