Abstract

The law establishes a Forestry Trust Fund into which shall be paid proportions of fees receive under this law and in accordance with the directions of the Board of the Fund. It establishes the Board of Trustees of the Fund to conduct its affairs and administration. The Board functions to; attract money into the Fund in order to enhance the afforestation programme of the State; provide funds for the establishment, management and conservation of forest resources; participate in the capitalization of research organizations formed by public and private enterprises, industrial firms or industrial groups; make grants for the furtherance of research and development in forestry, in accordance with the national policy of agriculture; and to provide funds for the commercialization of research and development results. The Board generally has powers to; do anything which in its opinion is calculated to facilitate the carrying out of its functions under this Law; open and operate accounts with any recognised banking institutions in Nigeria; invest monies in stock, bonds, research projects and commercialization of research results when the need arises; entertain or consider and accept applications for funds in relation to the functions specified in section 3 of this Law; and appoint specialist committees to assess applications for grants. The Law grants the state Commissioner with powers to withdraw the operation of all or any provisions of this Law to any class of persons, community or part of a community or any specified area. The Commissioner is further granted powers to constitute forest reserves and declare specially protected forests amongst lands at the disposal of the government, or any lands which in the opinion of the Commissioner, should be protected or reserved, or forest growth be established. As such, the Law protection, control and management of forest reserves, protected forests and specially protected forests is exercised and direct by the Commissioner, who is also charged with granting all forms and manner of licenses and making regulations regarding forestry operations.
