Abstract

This is a subsidiary legislation of the Forest Law of Enugu State. These Regulations are made by the Commissioner for Agriculture of the State to apply to all forest reserves, protected forests and to all lands at the disposal of the State Government and to Communal Lands. The Regulations relate to the granting of permits to enter into forest reserves in order to harvest forest produce, and the extent of these rights. The permits relate to the type of forest produce to be taken, restrictions on the usage, restrictions on the quantity to be taken, restrictions on the machinery to be used, free permits, etc. It provides penalties for the destruction of protected trees, sell of the forest produce, employing assistance for harvesting forest produce when granted a singular right, etc. Furthermore, the Regulations make it an offence to block waterways with timber. The Regulations also provide that a forest officer, after notice has been served may enter any land adjoining a forest reserve, in respect of which the notice was published and do all things necessary for effecting the demarcation of the boundaries of the land.
