Entry into force notes
They shall come into force on the date of their publication in the Official Gazette and food business operator shall comply with all the provisions of these regulations with effect from 1st July, 2021, except sub-regulation (5) of regulations 3 and sub-regulation (1) of regulations 5 which shall come into force only from such date as the Food Authority may, by notification in the Official Gazette, appoint.
Abstract

These Regulations are framed pursuant to the powers conferred by clause (v) of sub-section (2) of section 92 of the Food Safety and Standards Act, 2006 (Act). Regulation 3 requires the School Authority selling or catering school meals by itself in the school campus to be registered as a food business operator (FBO) under the Act, rules or regulations made thereunder and ensure that the food is safe and balanced. It also states that FBOs selling or catering food on school campus shall ensure compliance to the requirements of sanitary and hygienic practices as specified under the Food Safety Standards (Licensing and Registration of Food Businesses) Regulations, 2011. Regulation 5 regulates the marketing, advertisement and selling of food products to children in school. Regulation 6 requires the School Authority to have a system of regular inspection of premises to ensure that safe, balanced and hygienic food is served to students and the State Food Authority to conduct surveillance and periodic inspection of food business operators to ensure compliance of the Act, rules and regulations thereunder. The Schedule provides general guidance for providing safe food and balanced diet to children.
