Abstract

These Regulations implement the provisions of article 6 of Council Regulation 170/83/EC which authorizes the State to restrict fishing by other Member States of the European Economic Community in certain areas within the exclusive fishery limits of the State. No person shall fish or attempt to fish in the part of the fishery limits that lies within 12 nautical miles seaward from the nearest point of the baseline (the "relevant part") from a fishing boat registered in another Member State of the EC unless: (a) the fishing takes place in the seaward half of the relevant part; (b) the boat is registered in a Member State; (c) fishing takes places in accordance with restrictions specified for each Member State and species of fish in the Schedule (reg. 3). Regulation 4 lists evidence that shall be considered prima facie evidence that a fishing boat was, at the time of offence, registered in a particular Member State.
