Abstract

This Subpart of Part 665 of Title 50 of the Federal Code of Regulations codifies certain provisions of the Presidential Proclamation of 2009 establishing the Pacific Remote Islands Marine National Monument and govern the administration of fishing in the Marine National Monument. It regulates and prohibits fishing activities in the area and provides with respect to fishing permit procedures and criteria. Commercial fishing is prohibited in the Monument. Non-commercial fishing is prohibited in the Monument, except as authorized under permit and pursuant to the procedures and criteria established in §665.935 or pursuant to §665.934(d). Commercial fishing outside the Islands Monument and non-commercial fishing within the Monument during the same trip is prohibited. The Regulations in this Subpart shall be applied in accordance with international law. No restrictions shall apply to or be enforced against a person who is not a citizen, national, or resident alien of the United States (including foreign flag vessels) unless in accordance with international law.
