Abstract

This Chapter of Division 2 of the Fish and Game Code of California concerns habitat restoration or enhancement projects. A person, public agency, or nonprofit organization seeking to implement a habitat restoration or enhancement project may submit a written request to approve a habitat restoration or enhancement project to the Director of Fish and Wildlife. “Habitat restoration or enhancement project” means a project with the primary purpose of improving fish and wildlife habitat. Project approval requires in principal certification pursuant to the State Water Resources Control Board’s Order for Clean Water Act Section 401 General Water Quality Certification for Small Habitat Restoration Projects. The Habitat Restoration and Enhancement Account is created in the Fish and Game Preservation Fund. The Act sets out rules for the screening of projects including consistency with fish passage guidelines.
