Abstract

The present Regulations enact subsection 63(1) and paragraph 63(2)(b) of the First Nations Oil and Gas and Moneys Management Act. In particular, the Regulations lay down provisions relating to environmental assessment of project concerning oil and gas explorations. In the administration of a first nation’s oil and gas law made in relation to environmental assessment, the decision-making authority and the council of the first nation shall exercise their powers in a manner that protects the environment and human health and applies the precautionary principle. The text – consisting of 55 sections – deals with the following matters: exploration activities, exempted projects, screening process, comprehensive study process, mediation and panel review process, previous assessment and termination of assessment, environmental assessment registry and coming into force. One Schedule is enclosed.
