This Law enters into force the day after its publication in the Official Gazette.
Abstract

This Law comprising 38 articles divided into V Chapters, aims to protect all consumer rights, including the right to a standard quality of goods and services and the right to obtain them at the declared price. It further seeks to preserve the health and safety of the consumer when using the goods or receiving the service and encourages healthy consumption patterns. The Law protects the data of the consumers and prohibits suppliers from using it for marketing. The Law applies to all goods and services sold or provided by suppliers, advertisers, and commercial agents across the UAE’s mainland and free zones. It also covers goods sold through eCommerce platforms registered in the UAE. Meanwhile, it does not apply to eCommerce activities that are carried out between customers in the UAE and eCommerce businesses registered outside the UAE. Among the Consumer Rights when purchasing a good or receiving a service there are (i) appropriate and safe environment; (ii) correct information; (iii) education and raised awareness in respect of his rights and obligations; (iv) right to choose the most appropriate product or service available in the market; (v) protected privacy and security of private data; (vi) respect of religious values, customs, and traditions; (vii) just and prompt settlement of disputes; (viii) fair compensation for damages incurred (art.4). The supplier also must (i) display the goods in a clear and legible manner; (ii) provide the consumer with a dated invoice that includes his trade name, address, type of goods or service sold or provided, its price and quantity. The invoice must be in Arabic and the provider may add any other language, as he deems fit. Article 9 states that in the event of a crisis, emergency circumstances, or unusual conditions in the internal or external markets, the Minister may take all necessary measures to protect and preserve the interest of Consumers from any harm, and he may issue a decision specifying the selling prices, and all suppliers in the State shall be bound by this decision. The Law prohibits and voids any contracted conditions that would harm the consumer. It also makes null and void, any clause of the contract that would exempt the supplier from any of the obligations stipulated in this Law (art.21).
