Abstract This Act underlines that all acts or trading practices prescribed or adopted by an enterprise, an association of enterprises, or a group of affiliated companies that result or are likely to result in the disruption or distortion of competition are prohibited. This Act applies to an enterprise that supplies any utility service set out in the Second Schedule to the Fair Trading Commission Act. This Act sets forth provisions on the establishment, financing, duties and authorities of the Fair Trading Commission, as well as reporting, inspection and investigation procedures. The Commission shall make available general information with respect to their rights and obligations under this Act, to persons engaged in business and to consumers. Furthermore the Commission shall co-operate with the Community Competition Commission for the purpose of enforcing compliance with the provisions of this Act, and with the competition authorities of other member states for the purpose of detecting and preventing anti-competitive business conduct and exchanging information relating to such conduct. The Director of Fair Competition shall be responsible for the discharge of the functions under this Act that are assigned to him by the Chief Executive Officer. This Act determines the unlawful acts in the fields of collective agreements by suppliers and dealers, and of maintenance of minimum resale prices. Finally, this Act sets forth provisions on judicial proceedings, offences, civil liability, confidentiality and prohibition of disclosure of information. The Commission may, with the approval of the Minister, make rules generally for giving effect to the provisions of this Act, and without prejudice to the generality of the Act.
