Abstract

This Executive Order is implemented in light of Article 6 of the Law on Protection and Utilization of the Country's Genetic Resources. The genetic resources are any material with plant or animal or microorganism origin with the value for reproduction. Article 1 of the Order provides for definitions related to genetic resources and Article 2 provides for actions that require license in the field of generic resource operations. The holders of biobanks and gene banks should perform theirs tasks under the granted license that cover collection, recognition, registration, protection, saving and submission of the genetic samples. The Department of Environment is in charge to provide a list of exclusive genetic resources, protected species, or those that are endanger of extinction. It is required that the principal habitats for access and utilisation of genetic resources would be introduced and the genetic resources would be locally and internationally registered. Consideration of ownership rights for those resources that are owned physically or through a patent license is required. The Order further provides for requirements for transit, import and export of the genetic resources. The Order is drafted in 41 Articles.
