Where a Minister is of the opinion that, having regard to the provisions of this Act, it is appropriate to establish an Executive Agency for the purpose of carrying out the functions of a department of his/her Ministry (s)he may, after obtaining appropriate authority, by Order published in the Gazette, establish such an Agency. The Permanent Secretary of a Ministry under which an Executive Agency is established shall be responsible for the strategic management of the Agency and, for that purpose, may give directions of a general nature to the Chief Executive. For each Executive Agency, the Minister responsible for the Agency shall establish a Ministerial Advisory Board.
