This section was inserted into the Act by the European Union (Planning and Development) (Environmental Impact Assessment) Regulations 2018, which provides for the making of an application to a planning authority for a screening determination as to whether a proposed development is likely to have significant effects on the environment. These Regulations give further effect in Irish law to Directive 2011/92/EU of the European Parliament and of the Council on the assessment of the effects of certain public and private projects on the environment, as amended.
