They Regulations provide rules for the award of concessions including award of contracts by utilities as defined by the European Union (Award of Contracts by Utility Undertakings) Regulations 2016. “Contracting authorities” are (a) a State, regional or local authority, (b) a body governed by public law, or (c) an association formed by one or more such authorities or one or more such bodies governed by public law, other than an authority, body or association which pursues one of the activities listed in Schedule 2 and awards a concession contract for the pursuit of one of those activities.
