The exemption previously provided for in the case of export or re-export is replaced with a new provision. In any proceedings for an offence under these Regulations, it shall be a defence for the person charged to show that the preservative in respect of which the offence is alleged to have been committed was intended for export and complied with the importing country's domestic food legislation relevant to the alleged offence.
