Abstract

These Regulations prohibit a fishing vessel flying the flag of a third State to land its catch at a port in Ireland, unless it has on board a certificate issued by its flag State showing that it complies with the requirements of Article 3, paragraphs 1, 2, 3 and 4 and Article 5 of the Council Directive 97/70/EC setting up a harmonized safety regime for fishing vessels of 24 metres in length and over. This rule applies to a category of fishing vessels defined by these Regulations. Authorized officers may detain vessels that are not in conformity with the established safety regime. If the authorized officer is unable to detain the vessel, the representative of the flag State concerned and the port authorities at the vessel's next port of call shall be notified.
