Abstract

The purpose of this law is to regulate relations between the State, citizens, business entities and organizations in order to guarantee the human right to live in a healthy and safe environment, an ecologically balanced social and economic development, the protection of the environment for present and future generations, the proper use of natural resources and the restoration of available resources. The document consists of 39 Articles. Article 1 determines the purpose of this Law. Article 2 regards legislation on environmental protection. Article 3 deals with resources protected by law and relevant definitions. Article 4 concerns the rights and the duties of citizens in protecting the environment. Article 5 establishes state environmental guidelines and principles. Article 6 deals with ownership of natural resources. Article 7 regards environmental assessments. Article 8 regards natural resources assessments. Article 9 regards environmental impact assessments. Article 10 deals with environmental monitoring. Article 11 deals with environmental research and funding. Article 12 concerns environmental information databank. Article 13 determines plenary rights of the State Ih Hural. Article 14 determines plenary powers of the Government. Article 15 determines plenary rights of the central State administrative body. Article 16 determines plenary rights of Aimag and capital city citizens’ representative Hurals and Governors. Article 17 determines plenary rights of Soum and Duureg citizens’ representative Hurals and Governors. Article 18 determines plenary rights of Bag and Horoo citizens’ representative Hurals and Governors. Article 19 establishes general methods and forms of environmental protection. Article 20 deals with environmental carrying capacity. Article 21 concerns protection from environmental pollution. Article 22 regards natural disaster and emergency areas. Article 23 deals with protection of the environment during states of emergency. Article 24 concerns maximum level of natural resource use. Article 25 regards restoration of natural resources. Article 26 regards environmental monitoring. Article 27 establishes rights and duties of State inspectors. Article 28 establishes rights and duties of rangers. Article 29 regards weapons and defensive weapons for use by State inspectors and rangers. Article 30 concerns certified organizations. Article 31 regards duties of business entities and organizations. Article 32 regards participation of non-governmental organizations in environmental protection. Article 33 deals with funding. Article 34 establishes economic incentives to protect the environment. Article 35 establishes fees and payments for use of natural resources. Article 36 regards ecological training and education. Article 37 establishes the modalities of compensation for damage caused to the environment. Article 38 establishes liability for breach of environmental protection. Article 39 determines the date of law coming into force.
