Abstract

These Regulations, made in exercise of the powers conferred by section 12 of the Environmental Planning and Protection Act, no. 40 of 2019, concern: environmental impact assessment; environmental management plan; environmental clearance conditions; proposed project. Matters covered by the Regulations include: prohibition against commencing proposed projects; mandatory application for preliminary review of proposed projects; requirements for certificate of environmental clearance, including: determination of application for proposed project, notice of submission of environmental impact assessment or environmental management plan, obligation to conduct a consultative process, notice of public consultation, consultative process and related information; certificate of environmental clearance; monitoring and compliance; environmental performance bond, including: environmental administration fund; penalties for false or misleading information. Attached schedules include guidelines for preparation of an environmental impact assessment.
