Abstract

This article of the Indiana Code concerns enforcement actions by the division of water. It provides that a division inspector or a person authorized by the department of environmental management of Indiana may at any reasonable time enter upon public or private property to determine if there is a violation. The department may also issue a written notice of violation. A person who fails to mitigate a violation within the time set forth in a notice of violation is liable for a civil penalty or permit revocation.
