Abstract

The Endangered Species Protection Ordinance 2015 provides under Part 2 and Part 3 for the discipline respectively of the Management Authority and of the Scientific Authority for the Falkland Islands. Scientific Authority. The general function of the Management Authority is to monitor the activities of Falkland Islands importers, exporters and re-exporters to ensure their compliance with CITES and with this Ordinance and must obtain the advice of the Scientific Authority before exercising any of its functions. The Management Authority must take appropriate measures to enforce the provisions of CITES and to prohibit trade in specimens in violation of CITES, and this duty includes- (a) to penalise trade in, or possession of, such specimens, or both; and (b) the confiscation or return to the State of export of such specimens (c) taking such supplementary measures as may be set out in regulations made by the Governor. The Management Authority must also maintain records of trade in specimens of species included in Appendices I, II and III to CITES.
