Abstract This Act regulates production, transmission, distribution, supply and consumption of electric energy. It shall be applicable to: (a) production of electric energy; (b) transmission and distribution of electric energy; (c) supply of electric energy, including import and export thereof; (d) regulation of electricity industry; (e) licensing. The Law consists of eight Chapters divided into 38 articles dealing with the following matters: general provisions (Chapt. 1, arts. 1 - 3); administrative competence and protection of consumers (Chapt. 2, arts. 4 – 12); licensing (Chapt. 3, arts. 13 – 18); access right to other’s real estate for installation, cabling, construction and repair of electric energy facilities (Chapt. 3, arts. 19 – 22); production, transmission, central dispatch, distribution and supply of electric energy (Chapt. 5, arts. 24 – 30); legal relationships between suppliers and consumers (Chapt. 6, arts. 31 – 35); tariffs (Chapt. 7, art. 36); final and transitional provisions (Chapt. 8, arts. 37 and 38). National Energy Regulatory Agency shall be authorized to issue and to withdraw licences for production, transmission, central dispatch, distribution and supply of electric energy. The licence for production of electric energy shall be issued for power plants of capacity equal to or exceeding 5 MW and if it is utilized for public purposes. Licence for power plants for one’s own use shall be issued for capacity exceeding 20 MW. Licences shall be open-ended.
