Abstract

This Title of Article 15 of the Environmental Conservation Law of New York (the Article 15 being known as the Water Resources Law of New York) regulates drainage. Its purpose is to grant the department of environmental conservation of New York the powers and duties for the drainage of agricultural land to the end that it may be made more productive, and in order to benefit the public health, safety and welfare. More specifically, the Title regulates drainage improvement districts; drainage improvement associations; entry upon lands, structures and waters, and condemnation; petition for formation of district; proceedings on petition; proceedings for formation of district; surveys and maps; drainage enhancements; proceedings on enhancements; proceedings on general apportionment of costs and final fixation of boundaries; corrections and revisions of statements of enhancements; procedure for authorization of construction; construction; contracts; operation and maintenance; major repairs of drainage works; minor repairs in drainage districts; minor repairs in existing drainage ditches; unlawful interference with drainage works; removal of beaver interfering with drainage works; financing of improvements; drainage improvement district fund; proceedings for assessment and collection of cost; drainage fund; corrections and revisions of assessments, determinations of drainage enhancements and apportionment of costs; drainage district with federal aid; formation of district with federal aid; transfer of property and discontinuance of district; drainage section association; creation of drainage section association; articles of association, recording and filing, meetings, members, officers, by-laws and its powers of association; and procedure for drainage of agricultural lands.
