Abstract

Rules and Regulations governing the Working and Living Conditions of Fishers on Board Fishing Vessels engaged in Commercial Fishing Operation. Pursuant to the authority of the Secretary of Labour and Employment to promulgate the necessary rules and regulations under Articles 5 and 168 of the Labour Code of the Philippines and the Administrative Code of 1987, as amended. This Department Order, consisting of 16 Rules, aims to: regulate the relations between workers and employers recognizing the right of labour to its just share in the fruits of production and the right of enterprises to reasonable returns on investment and to expansion and growth; guarantee and respect the free exercise of the commercial fishing workers to form union and organize for collective bargaining and/or for their mutual aid and protection; and ensure that fishing vessels are sea-worthy and compliant with the standards of safety of life at sea, safe manning requirements and occupational safety and health standards under applicable laws and regulations. These Rules shall apply to fishing vessel owners, fishers and captains or masters on board Philippine-registered fishing vessels engaged in commercial fishing operation in Philippine or international waters, except in the following: those on board commercial fishing vessels with foreign registry, which shall be governed by applicable rules and regulations of the POEA; those engaged in municipal fishing, which shall be governed by existing labour, fishery, maritime, and local government laws, rules and regulations; and those on board fishing vessels engaged in subsistence or recreational fishing.
