For this purpose a Department of Marine and Wildlife Resources is established under section 3 within the Executive branch of the government. This Office shall manage, protect, preserve and perpetuate the marine and wildlife resources in the Territory. Specific duties and powers are defined in section 4. There shall be a Director of Marine and Wildlife Resources. A fish and fish products dealer, a fisherman, a fish processor or a fish wholesaler shall keep records on his or her trade in accordance with sections 5, 6, 7 and 8 respectively. The Director, and such Department employees as the Director designates, shall have the authority to issue citations, collect fines, impound vessels and equipment, and make arrests for violations of this Chapter and any Rules or Regulations made under it (sect. 10). Section 11 prohibits gillnet fishing in territorial waters of American Samoa and prohibits assistance to fishing with gillnet or sale of fish taken by such method or the sale of gillnets.
