Abstract This Decree, based on the provisions of the Serbian Law on agricultural land, prescribes the necessary conditions, method and procedure for granting state-owned agricultural land for use as for non-agricultural purposes, as well as the criteria for determining the amount of compensation for granting state agricultural land for such use. This text applies to land that is registered in the real estate cadastre of the Republic Geodetic Institute by type as agricultural land owned by the Republic of Serbia. Cadastral plots that are subject to restitution in the sense of the law governing the return of land to previous owners cannot be subject to use defined in this text. State agricultural land can be put to use for: 1) energy production using renewable sources of wind and solar energy by building, i.e. installing: (1) wind power plant with accompanying infrastructure (windmill facilities, transmission lines, pylons, other facilities in the function of the power plant, lighting, etc.) and equipment for the production of electricity using wind energy; (2) solar energy power plant with accompanying infrastructure (solar panel facilities, transmission lines, other facilities in the function of the power plant, lighting, etc.) and equipment for the production of electricity using solar energy; 2) performing geological exploration works, i.e. exploitation of mineral raw materials: (1) clay, gravel, sand, stone, etc., (2) oil and natural gas with facilities in the function of geological research, ie oil and gas exploitation; 3) carrying out works on the disposal of tailings, ash, slag and other dangerous and harmful substances on agricultural land for a certain period of time with the submission of the necessary approvals issued by the ministry responsible for mining and geology.
