Abstract

This Decree aims to exercise category management of EIA of construction projects based on the extent of impact construction projects will have on the environment. The List is formulated in accordance with Article 16 of the Environmental Impact Assessment Law. In line with provisions of the List, construction agencies shall undertake the responsibility of preparing environmental impact statement (EIS) and environmental impact form (EIF) or filling in environmental impact registration form. The nature and extent of sensitivity of the environment where construction projects are located are major basis for determining the category of EIA. EIA category of cross-sector and comprehensive construction projects shall be determined according to the highest level of individual indicators. For construction projects not included in the name list, the EIA category shall be proposed by provincial environmental protection department to the competent national environmental protection authority under the State Council for approval according to the characteristics of pollution factors and ecological influence factors of the projects as well as the nature and extent of sensitivity of the environment that the projects are located in.
