Abstract

This Decree regulates expropriation of plot of land or part thereof and the modalities of calculation of compensation to natural and legal persons due to expropriation of land for public needs. Expropriation of land for public needs shall be carried out by consent of landowner or by agreement with land tenant or lessee – by decision of local executive bodies, regional authorities and Cabinet of Ministers. In case of dissent of landowner, land tenant and lessee the aforesaid decision can be challenged in court. Expropriation of land shall be carried out on condition of full compensation of losses caused by expropriation of land for public needs. In case of expropriation of a plot of land used by citizens on condition of lifelong hereditary possession acquired thereby through tender a new equal plot of land shall be allotted thereto on condition of lifelong hereditary possession.
