Abstract

This Decree is divided into three Chapters. In Chapter I, article 1 prescribes that amateur fishing in maritime zones under national jurisdiction shall be practised only under the terms established by this Decree. It also defines"superficial fishing" and "underwater fishing". Article 2 defines "amateur fishermen" and establishes that fishing for commercial purposes is prohibited and that any person or other entity is prohibited from selling fisheries products caught by amateur fishing. Such a prohibition shall not apply in the cases described in article 8 of this Decree. Chapter II (arts. 3-12): Article 3 prescribes that amateur fishing may be practised by persons holding an individual licence or under an agreement between the Government and recreational fishing entities. Amateur fishing is allowed subject to a fishing licence, except in cases described in section 2 of this article; licences are issued by the competent authorities, may be renewed and are subject to payment of a fee. Fishing with lines from the shore is exempt from the requirement of a licence (art. 4). Amateur fishermen must comply with the protection measures in force, in particular those prescribed by this Decree and other regulations. Violations of this Decree shall be punishable by revocation of the licences as well as sanctions (art. 5). There is no limit to fish catch, except for restrictions on certain fish species according to articles 2 (para. 2) and 13 of this Decree (art. 6). Special regulations apply to underwater fishing (art. 7): such fishing is forbidden within 50 meters from the coast and must be at a distance of 20 meters from other underwater fishermen. Local maritime navigation rules must also be respected. Underwater fishing is prohibited to persons under the age of 16. Persons under the age of 18 may obtain a written permit. For fishing licences a medical certificate is required. Amateur fishing may be authorized by agreement between tourism and amateur fishing entities (art. 8). Amateur Fishery Agreements also specify requirements such as authorized fishing methods and limitations, fees and duration of the agreements (art. 9). The Amateur Fishing Entity shall monitor compliance with these requirements. Violations may lead to termination of the contracts or sanctions (arts. 10-11). Amateur Fishing Boards are responsible for violations by their members of Decree-Law No. 17/87 of 18 March 1987 (art. 12). The control of non-commercial amateur fishing shall be the responsibility of the Secretary of State for Fisheries and the Ministry of Tourism (art. 13). The Secretary of State for Fisheries issues amateur fishing licences. The Ministry of Tourism and the Secretary of State of Fisheries establish the respective regulations (art. 14).
