Abstract This Decree, consisting of 29 articles and three Annexes, establishes norms and procedures for the environmental licensing of aquaculture activity within the State of São Paulo. It specifies that the use of indigenous or native species and alien or exotic species will be allowed, only respecting the current legislation. In the case of an aquaculture activity using alien or exotic species, specific procedures and measures should be adopted. The Institute of Fisheries, of the Secretariat of Agriculture and Supply, will define by ordinance the list of species whose cultivation will be allowed as well as the authorized places to breed each species. Aquaculture licensing for species not included in the enclosed list will depend on prior and specific manifestation of the Institute of Fisheries, of the Secretariat of Agriculture and Supply, authorizing the breeding of specific species in the area subject to the license application. The list of alien/exotic species and authorized places must be reviewed every 24 months. The breeding of species in net tanks shall only be authorized if there is the installation of devices to ensure the non-escape of adult species to public waters.
