This Decree enters into force on the day of its publication.
Abstract

This Decree creates the State Programme to Encourage the Cleanup and Silt removal of Surface Water of the State of Rio Grande do Sul in order to reduce the damages caused by floods. The environmental licensing, at the state level, for activities of desilting and cleaning of vegetation and discarded solid waste to be carried out by the municipalities will have the following conditions: any interventions on ​​water bodies carried out in the Permanent Preservation Area must minimize the impact, prioritizing access to degraded areas; cleaning and desilting methods cannot alter the natural bed of the water body, restricting the removal of the deposited material by sedimentation process; intervention sites must be signalized during the desilting; dredging area and the dredge itself must be marked as provided for in the Brazilian Navy's Maritime Authority Regulations for Navigation Aids, NORMAM-17/DHN; the transport of the water body removed material from the place of cleaning to the final destination, must avoid spillage to prevent accidents; removed waste during dredging should be destined to sites licensed by the competent environmental agency; interventions cannot affect native vegetation threatened with extinction and protected; vegetation of the Permanent Preservation Areas should be restored so that the environmental balance will mitigate erosive processes and accidental movements of mass and floods; desilting waste disposal cannot be deposited in a Permanent Preservation Area; and the identification of stretches subject to continuous and frequent processes of desilting should be included in the Master Plan or in the municipality guidelines.
