Abstract

This Decree establishes the procedure for withdrawal (withdrawal) from circulation, return, export, disposal of dangerous products by the manufacturer (supplier, seller, importer) in order to prevent circulation of such products on the territory of the Republic of Belarus. It shall not apply to dangerous products, withdrawn, seized or converted to the benefit of the state in accordance with the procedure established by legislative acts. Competent bodies shall classify products as hazardous based on the results of laboratory research (tests) conducted by in accredited testing centers (laboratories); and on the basis of documents issued by the results of external inspection. Termination of import and/or circulation of hazardous products in the territory of the Republic of Belarus, their withdrawal (recall) from circulation shall be carried out by a business entity on the basis of the prescription issued by the competent authority. A business entity upon receipt of an order within a period of not more than 10 working days from the date of its receipt determines the possibility of bringing hazardous products into compliance with the requirements of technical regulations and informs the competent authority about the decision in written (electronic) form. The period of adjustment of hazardous products in accordance with the requirements of technical regulations must not exceed two months. A business entity is obliged to confirm the result of compliance of hazardous products with the requirements of technical regulations through implementation of the procedure of conformity assessment in accredited bodies and testing centers. In the event that hazardous products cannot be brought into compliance with the requirements of technical regulations within the specifies period, it shall be subject to disposal or return.
