This Decree enters into force on the day of its publication.
Abstract

This Decree, consisting of 19 articles and one Annex, establishes norms and procedures for the environmental licensing related to mineral extraction activity within the State of Espírito Santo. It establishes the general guidelines for obtaining the environmental licence to perform mineral extraction activity, which will take into account the stage in which the enterprise is located in the National Department of Mineral Production (DNPM), as well as the distinction between the different degrees of potential environmental impact presented by the different types of mineral goods to be extracted. In cases where there is a framework under the Mining Licensing Exemption under the DNPM, there will be no environmental licence for mineral extraction, and the use of the material must be licensed in conjunction with the specific work for which it is intended. The competent Environmental Authority shall establish regulations to deal with the procedures that will be applied to this case.
