Abstract

The state testing of plant varieties for patentability shall be carried out by the Ministry of Agriculture and Food and by the State Inspection for Testing and Protection of Plant Varieties. The Patent Authority after the receipt of the patent application and carrying out the preliminary expertise must forward the materials to the State Testing Commission for testing of the plant variety for novelty, distinguishability, homogeneity and stability. Testing of plant variety for patentability shall be carried out by means of the ground approbation and laboratory testing in conformity with the state standards. In the process of valuation of plant variety the conclusions of the State Commission can be based on: 1) the results of field and other testing carried on in conformity with contracts by legal and natural persons of the Republic of Belarus or by the foreign states that have signed bilateral or multilateral agreements on plant protection with the Republic of Belarus; 2) tests carried out by the applicant or on behalf of the applicant in the Republic of Belarus or abroad.
